Grievance Form

Applications need to be received prior to the first day of grievance hearings (Postmarks will not be accepted). Please fill out a separate application for each property to be grieved.

It is the responsibility of the taxpayer to prove a different fair market value other than the current assessment. Please review the following guidelines prior to submitting your request for grievance:

1) The Listers/Assessor use the definition of fair market value according to state statute V.S.A 32 § 3481 to determine the assessed value of your property. A small, limited number of properties in Londonderry are assessed using alternative methods when statutorily required. Some examples of these properties would be qualified housing or covenant restricted properties, in which case the methodology for valuation can be found in state statute V.S.A 27 § 610 & V.S.A 32 § 5404a(a)(6).

2) Please provide a brief statement of why you feel your assessment is incorrect. Attach your analysis, appraisal, construction plans, or any other documentation to support your proposed value for the property. If there are physical inaccuracies in the property record card, please identify them. (Property Record Cards can be located at https://next.axisgis.com/LondonderryVT/#)

3) Review recent arm length sales of properties that are similar to your property, providing three or more comparable.

4) If the concern is Homestead or House site, please include any applicable data [such as VT #HS-122/HI-144 [Homestead Declaration] – i.e. Proportion of property used for commercial purposes

5) If your property is enrolled in the Current Use program, the Listers/Assessor are required to comply with state statue V.S.A 32 § 3756. Further information about the current use guidelines can be reviewed on the current use application CU-301. If you don’t have a current copy of your current use applications or map, please reach out to the Vermont Property Valuation and Review Current Use program at 802-828-5860. 6) If your property is commercial, please see the attached commercial income form and submit the requested information with the grievance request. Vermont statue 32 V.S.A § 400(C), listers have the authority to require certain information to appraise a property at fair market value. The income approach is typically used to value commercial or industrial properties.

For all structures on the parcel, please provide the following items for the past three years, certified by an independent third party:

A) Annual expenses for all property use: PVR Form VT-4004.exp

B) Apartment use property - rental income statement:  PVR form VT-4004.Apt

C) Commercial & Industrial property - lease/rental terms PVR Form VT-4004-CI

D) Copy of all the lease agreements: 1) Identify if the owner occupies and uses space on the property. 2) If there are common area maintenance fees, break out how these fees are paid.
